Shipping & Delivery Policy

1. STATUS, SCOPE AND INCORPORATION

1.1 This Shipping Policy (the “Policy”) governs the dispatch, shipment, delivery and logistics procedures applicable to purchases concluded through the Wizbay online marketplace platform (the “Platform”), operated by WIZBAY LTD (“Wizbay”).

1.2 This Policy forms an integral part of the Wizbay General Terms & Conditions, Seller Terms & Conditions and Returns & Refund Policy (collectively, the “Platform Terms”). Capitalised terms not defined herein shall have the meanings assigned in the Platform Terms.

1.3 Wizbay operates the Platform in multiple legal capacities depending on the transaction concerned:

a) as Marketplace Operator, facilitating transactions between Buyers and third-party Sellers;
b) as Seller, where Wizbay is expressly identified as seller of record in the Order Confirmation; and
c) as Logistics and Shipping Administrator, coordinating shipment processes, tracking integrations and delivery verification mechanisms across the Platform.

1.4 The coordination or administration of shipping logistics by Wizbay shall not, by itself, render Wizbay the seller or carrier of goods unless Wizbay is expressly identified as seller in the Order Confirmation.

 

2. IDENTIFICATION OF SHIPPING RESPONSIBILITY

2.1 The entity responsible for dispatching goods shall correspond to the seller identified in the Order Confirmation.

2.2 Where a third-party Seller is identified, that Seller remains responsible for packaging, dispatch and compliance with shipping obligations, unless Wizbay expressly assumes logistical coordination pursuant to Platform procedures.

2.3 Where Wizbay is identified as Seller, shipment may be performed through logistics providers, warehouses or fulfilment partners acting on Wizbay’s behalf.

2.4 Logistics providers and warehouses engaged in shipment act solely as independent service providers and shall not be deemed contracting parties to the sale.

 

3. SHIPPING METHODS AND CARRIER SELECTION

3.1 Shipping methods available for each order shall be displayed during checkout and may vary depending on destination, product characteristics, warehouse location and carrier availability.

3.2 Sellers shall ensure that shipping methods selected are appropriate for the nature, value and fragility of the goods.

3.3 Wizbay may integrate or designate specific carriers, tracking systems or logistics technologies to ensure operational consistency and dispute verification capability.

3.4 Wizbay reserves the right to restrict or modify shipping options where necessary to ensure compliance with applicable law, sanctions regimes, customs requirements or risk-management considerations.

 

4. ORDER PROCESSING AND DISPATCH TIMEFRAMES

4.1 Sellers shall dispatch goods within the processing timeframe stated in the product listing or otherwise communicated during checkout.

4.2 Where no timeframe is specified, dispatch shall occur within a commercially reasonable period consistent with applicable consumer protection law.

4.3 Dispatch confirmation shall include tracking information where available.

4.4 Failure to dispatch within stated timeframes may result in:

a) order cancellation;
b) refund initiation;
c) dispute escalation; or
d) enforcement measures under the Platform Terms.

 

5. TRACKING, DELIVERY CONFIRMATION AND EVIDENCE

5.1 Sellers shall provide valid tracking information where shipping services support tracking functionality.

5.2 Wizbay may rely on courier tracking data, carrier delivery confirmations, scan records, geolocation data or equivalent logistics information to determine delivery status.

5.3 Delivery confirmation recorded by an integrated carrier system may constitute sufficient operational evidence of delivery for purposes of dispute resolution.

5.4 Buyers acknowledge that delivery evidence assessed through the Platform may be relied upon in determining eligibility for refunds under the Returns & Refund Policy.

 

6. DELIVERY ATTEMPTS AND FAILED DELIVERY

6.1 Buyers shall ensure that delivery information provided at checkout is accurate and complete.

6.2 Where delivery fails due to incorrect address information, absence of recipient, refusal to accept delivery or failure to complete customs requirements, responsibility for resulting costs or delays may rest with the Buyer, subject to applicable law.

6.3 Re-delivery or redirection arrangements may be subject to carrier policies and additional charges.

 

7. RISK TRANSFER AND RESPONSIBILITY DURING TRANSIT

7.1 Risk in goods shall transfer in accordance with applicable law and the contractual allocation between Buyer and Seller.

7.2 Where the Buyer acts as consumer under applicable law, risk shall generally pass upon physical possession of the goods by the Buyer or a person designated by the Buyer.

7.3 Coordination of shipping logistics by Wizbay shall not alter statutory risk allocation unless Wizbay acts as Seller.

 

8. INTERNATIONAL SHIPPING AND CUSTOMS

8.1 Orders shipped across international borders may be subject to customs clearance procedures, import duties, taxes or regulatory inspections imposed by destination authorities.

8.2 Responsibility for customs duties, import taxes and regulatory compliance shall be allocated as disclosed during checkout or otherwise specified in the listing.

8.3 Delays caused by customs authorities are outside Wizbay’s control and shall not constitute delivery failure.

8.4 Buyers and Sellers shall cooperate with reasonable requests for documentation required for customs clearance.

 

9. SHIPPING DELAYS AND FORCE MAJEURE EVENTS

9.1 Delivery timeframes are estimates only unless expressly guaranteed.

9.2 Shipping delays may occur due to carrier disruption, weather conditions, customs inspections, geopolitical events, regulatory actions or other circumstances beyond reasonable control.

9.3 Such delays shall not automatically entitle cancellation or refund unless thresholds defined in the Returns & Refund Policy are met.

 

10. CENTRALISATION AND INTERACTION WITH RETURNS PROCESS

10.1 Shipping procedures operate in conjunction with Wizbay’s centralised returns system.

10.2 Shipment tracking and delivery evidence may be used to trigger return eligibility, dispute classification or refund processing.

10.3 Buyers and Sellers acknowledge that logistics data may be relied upon by Wizbay in administering dispute outcomes.

 

11. PROHIBITED SHIPMENTS AND COMPLIANCE

11.1 Sellers shall not ship prohibited or restricted goods in violation of applicable laws, export controls or platform policies.

11.2 Wizbay may suspend shipments, cancel orders or remove listings where legal compliance concerns arise.

 

12. LIABILITY LIMITATIONS RELATING TO SHIPPING

12.1 Wizbay shall not be liable for acts or omissions of carriers, logistics providers or customs authorities except where Wizbay acts as Seller and liability cannot be excluded under applicable law.

12.2 Nothing in this Policy limits mandatory consumer rights.

 

13. AMENDMENTS AND CONTACT

13.1 Wizbay may amend this Policy by publication on the Platform.

13.2 Continued use of the Platform constitutes acceptance of amendments.

13.3 Shipping enquiries shall be submitted via Platform support channels or [support email].
